Distance Selling Agreement

1. Introduction & Legal Framework
These Terms of Service constitute a legally binding Distance Selling Agreement between you (the Customer) and Onedayprints (the Seller). By purchasing from our store, you agree to be bound by these terms and all applicable laws and regulations.

This Agreement is governed by and construed in accordance with the laws of the Republic of Türkiye, while also adhering to international consumer protection standards for our global customers:

For European Union (EU) Customers: In compliance with the EU Consumer Rights Directive (2011/83/EU) and the Electronic Commerce Directive. Data processing is handled in accordance with the General Data Protection Regulation (GDPR).

For United States (USA) Customers: In compliance with the Uniform Commercial Code (UCC), the rules of the Federal Trade Commission (FTC) regarding mail-order and online sales, and applicable state-level consumer protection laws (including CCPA for California residents where applicable).

Global Sales: For all other regions, international e-commerce standards and the United Nations Convention on Contracts for the International Sale of Goods (CISG) principles apply where relevant.

By placing an order, you acknowledge that you have read and understood these terms, particularly the sections regarding Custom-Made & Personalized Goods, which are exempt from standard "right of withdrawal" or "cooling-off" periods under both EU and US consumer laws.

2. Shipping, Logistics, and International Customs

Onedayprints delivers worldwide. By purchasing from our store, you acknowledge and agree to the following shipping and tax conditions:

  • Shipping Costs: Standard or express shipping fees are calculated at checkout based on your location and order volume. We partner with reliable global carriers to ensure your custom stationery reaches you safely.

  • Delivery Address: You are responsible for providing a complete and accurate shipping address. Onedayprints is not liable for delays or non-delivery caused by incorrect address information or the recipient's absence at the time of delivery.

  • Customs Duties, Taxes, and Fees: * International Orders: For customers outside of the Republic of Türkiye (including EU, USA, and UK), your order may be subject to import duties, VAT, or local customs taxes levied by the destination country.

    • Recipient’s Responsibility: All such additional charges are the sole responsibility of the Customer. Onedayprints has no control over these charges and cannot predict their amount.

    • Refusal of Delivery: If a package is returned to us because the customer refused to pay customs duties or taxes, no refund will be issued for personalized/custom-made items (as per Section 4: Returns & Cancellations).

  • Delivery Estimates: While we strive for 24-48 hour design turnarounds, international shipping times vary. We are not responsible for delays caused by customs clearance processes in the destination country.

3. Intellectual Property, Copyright, and Personal Use License

Onedayprints invests significant artistic effort, time, and creativity into every custom illustration and design. All original artworks, including but not limited to Watercolor Venue Sketches, Lineart Illustrations, Gatefold Templates, and Custom Prints, are the exclusive intellectual property of Onedayprints.

By purchasing from us, you agree to the following legally binding terms under the laws of Türkiye (FSEK), the European Union (Copyright Directive), and the United States (DMCA):

  • Limited Personal License: You are granted a single, non-transferable, and non-exclusive license for strictly personal use only. You may use the designs for your own wedding, baby shower, or home decor.

  • Ownership of Art: The purchase of a physical or digital product does not transfer the copyright to the Customer. Onedayprints retains full ownership of all original illustrations and design elements.

  • Prohibited Actions (Strict Enforcement): You are strictly prohibited from:

    • Reselling, redistributing, or sharing the digital files or physical designs in any form.

    • Using our artwork (especially custom venue sketches) for commercial purposes, branding, or sub-licensing.

    • Creating "derivative works" (altering our design to sell it as your own).

  • Legal Action & Enforcement: Any unauthorized use or "theft" of our designs will be treated as a copyright infringement. Onedayprints reserves the right to:

    1. File DMCA Takedown Notices (USA) to remove infringing content from Etsy, Shopify, Instagram, or any website.

    2. Pursue legal action for damages under the Turkish Law on Intellectual and Artistic Works (FSEK) and EU Intellectual Property Law.

    3. Report fraudulent activity to global payment providers (PayPal, Stripe, etc.).

4. Pricing, Payments, and Secure Transactions

At Onedayprints, we ensure full transparency in our pricing and a secure checkout experience for our global customers. By placing an order, you agree to the following:

  • Pricing & Currency: All prices are as displayed on our store at the time of purchase. Prices are subject to change without prior notice; however, any price changes will not affect orders that have already been confirmed and paid.

  • Taxes & Duties (Global Compliance): * EU/UK: Prices may include or exclude VAT depending on the specific marketplace rules (e.g., Etsy's automated VAT collection).

    • USA: Applicable Sales Tax will be calculated at checkout based on the delivery state's regulations.

    • International: Customers are responsible for any local taxes or customs fees as outlined in Section 3.

  • Secure Payment Processing: To ensure the highest level of security, we process all payments through globally recognized and PCI-DSS compliant third-party gateways (such as Stripe, PayPal, or specialized bank gateways). Onedayprints does not store or have access to your credit card or sensitive financial information.

  • Order Fulfillment: Production and design processes (including your custom watercolor or lineart sketch) will only commence once the payment is successfully authorized and confirmed.

  • Errors in Pricing: In the unlikely event of a technical error where a product is listed at an incorrect price, we reserve the right to cancel the order and provide a full refund before the design process begins.

5. Cancellations, Returns, and Refunds

At Onedayprints, we strive for perfection in every custom piece. Due to the highly personalized nature of our products (Custom Watercolor, Lineart, Gatefold Suites, and Personalized Prints), our refund policy is governed by the following global consumer standards:

  • Custom & Personalized Goods (No Returns): In accordance with the EU Consumer Rights Directive, UK Consumer Contracts Regulations, and US Federal Trade Commission (FTC) guidelines, items that are made to order or clearly personalized are exempt from the standard right of withdrawal. Once the design process for your custom illustration has begun, we cannot offer a full refund or return.

  • Cancellation Before Design Starts: You may request a full cancellation and refund within 6 hours of placing your order, provided that our design team has not yet started working on your custom sketch or layout.

  • The Approval Process (Your Safety Net): To ensure your satisfaction, we provide a digital preview of your custom design.

    • You have the right to request reasonable revisions (as specified in your product description) before final approval.

    • Once you provide final written approval for printing or final digital delivery, no further changes or refunds can be processed.

  • Damaged or Incorrect Physical Items: If your physical order arrives damaged or if there is a printing error on our part (different from the approved preview), please contact us via Email or WhatsApp within 48 hours of delivery with photos of the issue. In such cases, we will provide a replacement or a partial/full refund at our discretion.

  • Digital Downloads (Non-Personalized): For instant download "DIY" templates that are NOT personalized, refunds are only available if the file has not been downloaded, due to the nature of digital goods.


6. Governing Law and Jurisdiction

These Terms of Service and any separate agreements whereby Onedayprints provides you with services or products shall be governed by and construed in accordance with the laws of the Republic of Türkiye.

To ensure the highest level of protection for our global community, we adhere to the following international legal standards:

  • European Union (EU) Customers: This Agreement respects the mandatory consumer protection laws of the EU Consumer Rights Directive and the Electronic Commerce Directive. In the event of a dispute, EU-based customers may also have the right to access the European Online Dispute Resolution (ODR) platform.

  • United States (USA) Customers: For our US-based customers, these terms are interpreted in alignment with the Uniform Commercial Code (UCC) and federal FTC consumer protection guidelines.

  • Amicable Resolution: Before pursuing any formal legal action, both parties agree to first attempt to resolve any dispute through direct communication via Email or WhatsApp. Our priority is to reach a fair and friendly resolution for every customer.

  • Jurisdiction: Should a formal dispute remain unresolved, it shall be subject to the exclusive jurisdiction of the courts and enforcement offices of Türkiye.
